Please read these Terms carefully. By accessing or using our Website and purchasing our fine jewelry ("Products"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not access the Website or use any of our services.

1. Eligibility

This Website may only be used by individuals who are 18 years of age or older and capable of forming legally binding contracts under the Indian Contract Act, 1872. By using this Website, you represent and warrant that you meet these eligibility requirements.

2. Account Registration & Mandatory KYC

To verify identity for fine jewelry transactions, you may be required to register an account and provide accurate, current, and complete information.

• Mandatory Identification: A valid Government-issued ID (such as an Aadhar Card or PAN Card) is required for identity verification at the time of delivery.
• High-Value Transactions: As per Government of India regulations, providing your Permanent Account Number (PAN) is mandatory for any purchases amounting to INR 2,00,000 or above (or equivalent in any currency).

Failure to provide valid KYC documentation will result in the cancellation of your order.

3. Made-to-Order Variances & Pricing Adjustments

Products are made-to-order and handcrafted. Because of this, the final material quantity (e.g., gold weight, diamond carats) may vary slightly from the website listing depending on your specific size, fit, and customization requirements.

• Price Adjustments: If the final material usage exceeds or falls short of the listed estimate, the final price will be adjusted accordingly.
• Collection or Refund: Any additional charges related to this variance will be collected before or at the time of delivery. In the event of an over-collection, the excess amount will be refunded to your original payment source or your company digital wallet, as agreed and consented to by you.

4. Payments, Technical Errors, & Refunds

We accept payments through secure gateways (such as Cashfree, Razorpay, Stripe, or any other PCI DSS compliant gateway). Prices are quoted in INR and are inclusive of applicable taxes/GST, subject to change without prior notice due to precious metal market fluctuations.

• Payment Failures & Glitches: If a technical error causes your payment to be deducted without an order being generated, contact our customer care channels immediately for resolution.
• Proactive Reversals: Our systems monitor for such technical failures independently of customer reports and initiate a reversal for any deducted payment that did not result in a successful order.
• Settlement Timelines: Refunds and reversed amounts are subject to the standard banking settlement time of 5 to 7 working days to reflect in your account.

5. Intellectual Property & Bespoke Design Rights

All content on this Website, including photographs, text, logos, and designs, is the exclusive intellectual property of Maison Amrit OPC Private Limited.

• Non-Replication of Third-Party Designs: Replication of any trademarked or proprietary design owned by another company is prohibited. If a customer requests a bespoke design that infringes on third-party intellectual property, and this fact is concealed by the customer or initially missed by our team, Maison Amrit reserves the right to cancel the order immediately upon discovery, and to charge the customer a penalty covering incurred manufacturing costs and potential legal liabilities stemming from the infringement.
• Protection of CAD Files: For bespoke and custom design orders, only visual depictions, 2D renders, or 3D mockups are shared for approval. Raw CAD (Computer-Aided Design) files or manufacturing blueprints are not provided to the customer under any circumstance.
• Design Ownership: Maison Amrit OPC Private Limited retains full ownership and all intellectual property rights to all jewelry designs, including bespoke and custom-commissioned pieces created for a customer.
• Exclusivity: Secrecy and exclusivity of a bespoke design can be maintained upon the customer's explicit request.

6. Shipping, Delivery Authentication, & Risk of Loss

We partner with secure, high-value logistics providers (such as Sequel, DHL, FedEx, etc.). All shipments are fully insured during transit.

• Delivery Authentication: Handover of the Product requires presentation of a secure One-Time Password (OTP) and an in-person physical check of a valid national ID (Aadhar or PAN).
• Risk of Loss: Risk of loss and title for items purchased by you pass to you upon our delivery of the items to the carrier, and subsequently, upon verified handover of the package to you at the destination.

7. Merchandise Display & Inaccuracies

We make every reasonable effort to display our Products accurately. The display and resolution of your specific screen or device may affect the colors and sizing you see. Product photographs are often magnified to show detail and are not sized relative to each other. Maison Amrit reserves the right to correct any typographical errors, inaccuracies, or omissions, including after an order has been submitted, without prior notice.

8. Limitation of Liability & Force Majeure

• Disclaimer: This Website and its services are provided on an "as is" basis. Maison Amrit OPC Private Limited disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.
• Force Majeure: We are not liable for any delay or failure in performance caused by circumstances beyond our reasonable control, including acts of God, governmental or customs restrictions, strikes, pandemics, or delays by courier services.

9. Governing Law & Jurisdiction

These Terms, and any separate agreements whereby we provide you Services, are governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms are subject to the exclusive jurisdiction of the courts located in Lucknow, Uttar Pradesh, India.
